Totowa, NJ Fence Permits: Local Rules and Planning Questions

Replacing a backyard fence and enclosing an indoor work area raise different questions in Totowa. Start with the property's zoning, the exact route and the purpose of each gate. Our Totowa fence installation page introduces local service options; this guide helps you prepare the permit discussion.

Does replacing an existing fence need a permit?

The Totowa Building Department expressly lists fence replacements among work requiring permits. An existing fence is therefore a reason to document the old layout, rather than assume the replacement is exempt.

The Borough's forms page links its Zoning Permit for Sheds and Fences. That form asks for a recent survey and separate diagrams for the current and proposed arrangements. Ask which application and inspections cover your particular scope, including a pool barrier or any proposed grading.

Mark the street line before choosing the height

Totowa Code §415-97 generally limits residential fences to three feet within 25 feet of a street line and six feet farther away. Business and industrial provisions differ. Those distances use the street line, so do not substitute the curb or pavement edge.

On a working copy of your survey, label each run, its proposed height and its distance from adjoining streets. Include both street frontages on a corner property. Ask the Building Inspector to mark any point where the permitted layout changes.

Corner lots have a specific street-side provision

Section 415-97(L) allows a six-foot fence in the street-facing side yard under specified conditions: it cannot extend beyond the house's rear setback, must sit three feet behind the property line and must preserve sight triangles. Chain link is excluded from that area. The Building Inspector determines the front yard when necessary.

Keep this corner-lot question separate from a general request for privacy. Bring the house footprint and a panel illustration to review. A layout accepted for a straight interior lot should not be copied onto a corner without checking its conditions.

Indoor partitions need a different design conversation

For an indoor enclosure, show door locations, walking routes, work areas and the proposed gate swings on a floor plan. Ask the Building Department which building and fire reviews apply. A rule about outdoor street-line height does not establish that an interior partition is acceptable.

Discuss commercial and industrial fence installation for the overall layout and chain link fence installation for mesh and gate options.

Prepare your Totowa estimate

The code also requires fences to remain within property lines and out of public rights-of-way. Use the New Jersey property-line planning guide to organize boundary and easement questions.

Request a Totowa fence estimate with photographs, your survey and the proposed lengths. The shared four-step process below covers your estimate, material options, confirmed details and installation.
