Bergenfield, NJ Fence Permits: Local Rules and Planning Questions
A backyard privacy fence and a street-facing fence can need very different layouts in Bergenfield. Before ordering panels, settle three questions: which approvals apply, where the surveyed boundary sits, and whether the proposed line reaches an intersection visibility area. This guide helps you prepare for that conversation.

Does a Bergenfield fence need a permit?
The borough’s Work Requiring Permits page lists fences as work needing zoning permits and asks for a survey for exterior projects. Separately, §186-45J requires a permit from the Construction Official, following Zoning Officer approval, for erection, alteration or reconstruction above 2 feet 6 inches. Ask the department which approvals your exact replacement or new installation requires; a short fence is not automatically exempt from zoning review.
How high can the fence be?
Under Bergenfield §186-45, Fences, residential and business fences have a six-foot height limit above ground. Subsection A gives lower limits near intersecting street lines: 36 inches for open fences and 30 inches for solid fences within 25 feet. However, §186-40F separately restricts obstructions above 2½ feet within its intersection sight triangle, and §186-45M limits fencing there. Have zoning reconcile these provisions for your survey rather than assuming a three-foot open fence is approved at a corner.
The fence section also requires fences inside property lines, without public right-of-way encroachment. Its application provision calls for a sketch on the property survey showing fence location and dimensions.
Turn the survey into a useful installation plan
Use a clearly marked copy for the proposed work and keep the original survey available. Label each run with its proposed height and panel type, then add gates, adjoining streets and changes in grade. Photograph any retaining walls or tight driveway entrances so the installer can discuss access and transitions.
For replacement work, show the existing line separately from the proposed line. Ask about any change in height, material or gate position before treating the job as a simple repair. If a boundary is uncertain, resolve it with a surveyor rather than using the old fence as proof.
Choose privacy where it will work
For an approved screening area, compare vinyl fence installation with wood fence installation. Bring an actual panel image to the review: a style name alone does not show its openings, finished height or how it will step along sloping ground.
Keep access in the brief too. Note the opening needed for lawn equipment and where a gate should swing without obstructing a walkway. If the fence is part of a pool enclosure, ask for a separate review of the applicable barrier and gate requirements; an ordinary yard-fence height allowance does not establish pool compliance.
Confirm the current requirements, then request an estimate
