Fair Lawn, NJ Fence Permits: Local Rules and Planning Questions

Replacing a fence in Fair Lawn is a good time to check the paperwork as well as the panels. A previous location or height does not automatically settle the next application. Explore fence installation in Fair Lawn, NJ with your survey and any earlier approval available.

A replacement still needs a zoning permit

Section 125-45.2B requires a zoning permit before a fence is erected, constructed or replaced. The Borough’s official zoning page also lists new and replacement fences and requests two copies of the property survey. Use its current application resources and confirm fees and supporting documents before submission.

When can a replacement avoid municipal board approval?

The conditional pathway in Fair Lawn’s fence ordinance, §125-38B concerns municipal board approval; it is not a blanket permit exemption. Conditions include no other property changes, no increase in fence size or height, a location within four inches of the existing fence, and an existing fence that was approved by a municipal board or complies with the code.

The section also requires a description or depiction, written certification and compliance with its other conditions. Crucially, subsection B(10) says this procedure applies only when the new fence is substantially constructed of wood. Ask the Borough to review the complete conditions rather than assuming a wood-to-vinyl change qualifies.

Front setbacks have a three-foot limit

Section 125-38A generally limits residential fences and walls to six feet, with a three-foot limit for fences, walls and hedges in the required front-yard setback and corner-lot transition area. New fences must stay within property boundaries, avoid public rights-of-way and present their finished side toward the street or adjoining property, with posts toward the interior.

Subsection C provides a specific rear-boundary exception for premises abutting Route 208 or New Jersey Transit property. It does not remove the three-foot front-setback and corner-transition restriction. Have the reviewer identify the applicable yard and any exception on your survey.

Prepare the survey before choosing a material

The Borough’s 2026 survey-checklist amendment, Ordinance 2775-2026 adds survey and certification requirements for property-related approvals. Ask which current survey or no-change documentation is accepted for your application and property type.

Compare vinyl fence installation for screening and aluminum fence installation for an open appearance after confirming the layout. Use our New Jersey property-line planning guide to organize boundary questions.

Then request a Fair Lawn fence estimate with your survey, existing-fence photos and desired gates. The four-step process below covers your estimate, options, confirmed details and installation review.
