Mahwah, NJ Fence Permits: Local Rules and Planning Questions
A Mahwah fence plan should show where privacy ends and the street-facing portion begins. That transition affects height and visibility, especially on corner properties. Start with the survey, then compare fence installation in Mahwah, NJ for the layout you want the Township to review.
Do new and replacement fences need a zoning application?
Mahwah’s official fence FAQ says all new fences and replacements require a zoning application. For minor repairs, it directs owners to contact Planning and Zoning to determine whether a permit is required. Reusing existing posts or following an old fence line does not answer the application question.
Use the Township’s current zoning forms and applications rather than an old contractor-hosted form. Prepare the address, block and lot, survey, proposed fence line, height and material. Ask which additional approvals apply to your specific scope before committing to an installation date.
Mark the front facade and every street frontage
Under Mahwah’s fence provisions, §24-5.6b, the general height limit is six feet above finished grade behind the principal structure’s front facade line, and four feet within the front yard. The finished side must face the neighboring lot. Section 24-3.4d3 also addresses both front yards on a corner lot.
The Township FAQ explains that corner lots have two front yards and that a front yard includes the portion abutting a street. Ask the reviewer to identify each yard and the facade line on the survey. A side lawn beside a second street should not automatically be treated as a six-foot fence location.

An open fence still needs a visibility review
Section 24-5.6b prohibits fences within an intersection sight triangle. An open appearance alone does not establish that the proposed location is acceptable. Mark driveways, street intersections, gates and proposed height changes so visibility can be checked with the complete layout.
Compare aluminum fence installation for an open design and vinyl fence installation for screening in an approved location. Private personal recreation facilities have separate code provisions; identify any court or pool function at the start.
