Montvale, NJ Fence Permits: Local Rules and Planning Questions
In Montvale, the position of a fence can matter as much as its height. Before choosing panels, mark your street frontage and property boundaries, then explore fence installation in Montvale, NJ with a layout that can be reviewed by the Borough.
Does Montvale require a fence permit?
Yes. Montvale’s fence ordinance, Chapter 196, §196-6 requires an application to the Building Department, a fee and an issued permit before construction. The application must include a survey, the fence height and location, its support method and construction materials. The applicant must also advise the Building Subcode Official of the construction date so an inspection can be arranged.
The Borough’s Building and Construction page lists both new and replacement fences among projects requiring permits. Use that current page for application resources and confirm the applicable approvals and fees rather than relying on an older downloaded form.
Why is a six-foot fence not the default?
Section 196-4 sets a general maximum of four feet unless another provision applies. Section 196-5 identifies circumstances permitting greater heights, including certain side or rear boundaries adjoining commercial uses or the Garden State Parkway. Other exceptions address roadway conditions, courts and nonresidential uses. Ask the reviewer to identify the exact provision that fits your lot before ordering a six-foot privacy fence.

Show both street-clearance measurements
Under §196-3G, a fence cannot be within 10 feet of a front-yard property line or 20 feet of a street’s pavement edge. Both yards on a corner lot are treated as front yards. These are different reference lines: measuring only from the curb or only from an existing fence can leave the proposal incomplete.
Mark both dimensions on the survey, together with gates and the front foundation line. Section 196-3 also requires fences to stay within property lines, avoid street encroachment and face their finished side toward the adjacent property or street. Floodplain fences need the Borough Engineer’s recommendations.
Turn the approved layout into a practical fence plan
Compare aluminum fence installation for an open appearance and vinyl fence installation for privacy where the approved height and location allow it. A material choice alone does not resolve setbacks or establish pool-barrier compliance.
