Oakland, NJ Fence Permits: Local Rules and Planning Questions
An Oakland fence can meet a height limit and still need a different location or panel design. Front-yard openness, roadway clearance and drainage each deserve a place on the plan. Explore fence installation in Oakland, NJ after identifying those constraints on your property.
What does Oakland’s code say about fence approval?
Oakland’s fence ordinance, §59-47E states that a construction permit is required before erecting a fence, with an exception for decorative garden or planting fences. It allows the Construction Code Enforcement Official to require a survey showing the proposed fence relative to property lines.
Describe whether you are adding a boundary fence, replacing a run or installing a small decorative feature. Ask the Borough which zoning and construction approvals apply under the current rules; do not assume a garden-fence exception covers a full yard enclosure. Confirm the current application checklist and fee before ordering.
A front-yard fence needs height and openness checks
Section 59-47E permits front-yard fences up to four feet above ground level when at least 50% of the fence is open. It also prohibits interference with driveway and intersection visibility, including on corner lots. For this fence subsection, the front yard is the yard where the front door and/or front of the house is located.
Bring a panel drawing showing rails, pickets and spacing. Ask how the proposed design’s open area will be evaluated. Separately mark the roadway: the code prohibits a dwelling-yard fence within ten feet of it to allow utility access and snow plowing.

Backyard privacy must leave drainage working
In residential districts, the general limit outside a required front yard is six feet. A taller fence, such as a tennis-court enclosure, requires a variance and the applicable accessory-building side and rear yards. The finished side must face outward.
The same section requires natural drainage to remain open and prohibits fencing that blocks or dams surface water into ponding. Photograph low spots, swales and existing retaining walls before deciding how panels meet the ground. Compare vinyl fence installation and aluminum fence installation against the reviewed layout.
Does a floodway affect the material choice?
Yes, if the property is affected. Oakland’s flood damage prevention code, §14-801.4 separately regulates floodway fences that can obstruct floodwater and addresses pool enclosures. Ask the Borough’s floodplain reviewer whether those requirements apply before choosing a solid panel. A general residential fence allowance does not resolve floodway approval.
