Rutherford, NJ Fence Permits: Local Rules and Planning Questions
In Rutherford, a six-foot backyard fence does not mean the same height can continue alongside the house. The yard designation changes the available height and can affect the whole design. Start planning fence installation in Rutherford, NJ by marking where each run will sit.
Read the front, side and rear heights separately
For interior lots in the code table’s All Other Zones column, Rutherford’s fence ordinance, §131-11B lists three feet in the front yard, four feet in the side yard and six feet in the rear yard. It separately lists heights for B-2, HC and ORD zones. Confirm the property’s zone before applying a column.
The Borough’s Building Permits and Zoning FAQ explains the residential three/four/six-foot pattern and says front-yard fences must be at least 50% open. Bring a panel drawing with spacing and height dimensions; describing a fence as decorative does not demonstrate its open area.

Corner lots have a separate street-side yard
Section 131-11B(5)-(6) defines residential corner-lot yards for fences, including a street-side yard beside the nonfrontage street. Its table lists a three-foot front, four-foot street side, four-foot side and six-foot rear, subject to the section’s conditions and the Code Official’s safety determination.
Section 131-10 also restricts structures, fences, plantings and walls over three feet within 20 feet of a street intersection to protect the sight triangle. Ask the reviewer to mark the street-address frontage, other street and visibility area on the survey. Do not treat every street-facing edge as an ordinary rear boundary.
Show pool and gate details in the application
The official FAQ requests a survey with the application and says a property with a pool also needs the building section of the UCC application alongside zoning. Identify whether a proposed fence or gate forms part of the pool barrier before selecting openings, latches or access points.
The residential fence provision also requires the finished side to face the street or neighboring property. Mark that orientation and each transition between heights on the drawing so the estimate and approval request describe the same work.
Choose a material for the reviewed layout
Compare vinyl fence installation for approved backyard screening and aluminum fence installation for an open appearance. A material selection alone does not establish height, sight-triangle or pool compliance.
